For the purposes of this Treaty: |
(a) „artyści wykonawcy” to aktorzy, piosenkarze, muzycy, tancerze i inne osoby, które grają, śpiewają, wygłaszają, deklamują, występują, interpretują lub w inny sposób wykonują utwory literackie, artystyczne bądź dzieła sztuki ludowej;

(a) „performers” are actors, singers, musicians, dancers, and other persons who act, sing, deliver, declaim, play in, interpret, or otherwise perform literary or artistic works or expressions of folklore;

(b) „fonogram” oznacza utrwalenie dźwięków artystycznego wykonania lub innych dźwięków, lub reprezentacji dźwięków, w inny sposób niż w formie utrwalenia włączonego do utworu kinematograficznego lub audiowizualnego;

(b) „phonogram” means the fixation of the sounds of a performance or of other sounds, or of a representation of sounds, other than in the form of a fixation incorporated in a cinematographic or other audiovisual work;

(c) „utrwalenie” oznacza zapis dźwięków lub ich reprezentacji, z którego mogą być postrzegane, kopiowane i przekazywane za pomocą odpowiednich urządzeń;

(c) „fixation” means the embodiment of sounds, or of the representations thereof, from which they can be perceived, reproduced or communicated through a device;

(d) „producent fonogramu” oznacza osobę fizyczną lub osobę prawną, która podejmuje inicjatywę i ponosi odpowiedzialność za pierwsze utrwalenie dźwięków wykonania lub innych dźwięków, a także ich reprezentacji;

(d) „producer of a phonogram” means the person, or the legal entity, who or which takes the initiative and has the responsibility for the first fixation of the sounds of a performance or other sounds, or the representations of sounds;

(e) „opublikowanie” utrwalonego wykonania lub fonogramu oznacza publiczne zaoferowanie zwielokrotnionego egzemplarza utrwalonego wykonania lub fonogramu za zgodą osoby uprawnionej, pod warunkiem że zwielokrotnione egzemplarze są oferowane publicznie w rozsądnych ilościach;

(e) „publication” of a fixed performance or a phonogram means the offering of copies of the fixed performance or the phonogram to the public, with the consent of the rightholder, and provided that copies are offered to the public in reasonable quantity;

(f) „nadawanie” oznacza bezprzewodowe przekazywanie dźwięków do odbioru publicznego lub też obrazów i dźwięków, lub ich reprezentacji; termin ten obejmuje także przekaz satelitarny lub przekaz za pomocą kodowanych sygnałów, jeśli urządzenia dekodujące są udostępnione publiczności przez tę samą organizację nadawczą lub za jej zgodą;

(f) „broadcasting” means the transmission by wireless means for public reception of sounds or of images and sounds or of the representations thereof; such transmission by satellite is also „broadcasting”; transmission of encrypted signals is „broadcasting” where the means for decrypting are provided to the public by the broadcasting organization or with its consent;

(g) „publiczne komunikowanie” wykonania lub fonogramu oznacza publiczne przekazywanie dźwięków wykonania lub dźwięków, lub reprezentacji dźwięków utrwalonych na fonogramie w jakikolwiek sposób, inny niż nadawanie. Dla celów artykułu 15 „publiczne komunikowanie” obejmuje także publiczne odtwarzanie dźwięków lub ich reprezentacji utrwalonych na fonogramie.

(g) „communication to the public” of a performance or a phonogram means the transmission to the public by any medium, otherwise than by broadcasting, of sounds of a performance or the sounds or the representations of sounds fixed in a phonogram. For the purposes of Article 15, „communication to the public” includes making the sounds or representations of sounds fixed in a phonogram audible to the public.
